The mobile phone would be the death of thenairobian. It helps very much but its very use lead us to unintended consequences. Just as one Nairobian lawyer. Well, Memba Muriuki was on Thursday or thereabouts charged with threatening to kill his wife, one Ms Jacqueline Achieng last year at locations unknown. The instrument of such threats appears to have been the mobile phone.
But that is getting ahead of the story. It appears that sometime back Memba Muriuki was arresting in respect of the matter and then released on a KShs. 30 000 bond on condition that he appeared in court on 12th January, 2010. Instead of appearing in court, it was however his Advocate who rocked up and informed the court, that the client got sick last week, was under medication and under observation by his doctor – one Dr. Kinuthia.
The prosecutor, one Onesmus Towett, was however not sold on that and requested the court to forfeit the Kshs. 30 000 bond and issue a Warrant for the arrest of the Nairobian lawyer. The magistrate, Hon. Mutembei of Court 1, High Court Nairobi for those who have no clue so far, thus listed the matter for mention on the 14th January, 2010 whereupon he ordered the issue of the Warrant of Arrest. A warrant that was luckily not executed as Memba Muriuki did rock up in court latter the same evening with the same being lifted and he being released on a Kshs. 30 000 cash bail.
So the charges are that on 13th December, 2009 he used a Safaricom like to send a message to J. Achieng using threatening and abusive language. And that he also improperly used a licensed telecommunication system.
And yes, for those who want to know, he has a firearm whose fate the court would decide on 19th January, 2010. The case comes up for hearing on 18th February, 2010, not that anyone wants to know anyway.
